NuvaRing Label Change and FDA Warnings

The NuvaRing contraceptive device was marketed by Merck as a safe and convenient alternative to birth control pills with fewer side effects. However, recent studies have shown these implants may increase the risk of dangerous blood clots.

As of this time, there has not been a NuvaRing recall. For now, experts continue to warn of the safety risks of these devices and demand that the FDA consider a ban on such contraceptives. Merck also faces more than 1,000 lawsuits by those injured, which are set to begin trials in early 2013.

In 2005, the FDA mandated that Merck change the NuvaRing warning label so that it would include information about:

  • The irregular bleeding associated with NuvaRing use
  • The fact that women with a history of heart disease, blood clots, and hypertension should not use NuvaRing due to their increased risk of developing serious NuvaRing side effects
  • The need to take precautions when using tampons due to the increased risk of Toxic Shock Syndrome (TSS)
  • Interactions with other drugs

NuvaRing warnings attempt to alert women who are using or are thinking about using NuvaRing of the potential for developing serious health complications. First approved by the Food and Drug Administration (FDA) in 2001, NuvaRing is up to 99 percent effective at preventing pregnancy and it is currently used by about 1.5 million women worldwide. NuvaRing is only available via prescription and it is produced and distributed by Merck (formerly Organon and Schering-Plough).

Clinical studies have shed light on the potential dangers associated with using NuvaRing. Increasing numbers of public NuvaRing warnings have been issued and have spurred some - including the public advocacy group Public Citizen - to petition the FDA to add a "Black Box" warning label to NuvaRing. A black box NuvaRing warning would indicate that this medication has the potential to cause life-threatening side effects. To date, the FDA has not issued a black box NuvaRing warning.

Since 2008, nearly 1,000 lawsuits have been filed against Merck, Schering-Plough and Organon, the drug companies responsible for NuvaRing marketing and manufacturing. The suits were filed by women seeking compensation for harmful NuvaRing side effects including deep vein thrombosis, pulmonary embolism, heart attack, stroke and other blood clot injuries.

If you suffered a blood clot, stroke, pulmonary embolism or DVT after using NuvaRing, it is important to speak with a lawyer. While there is no NuvaRing Recall, you may be entitled to substantial compensation.

Women have several options for filing a lawsuit against the drug companies responsible for NuvaRing. Multi-district litigation is the best option, as these cases are consolidated under the jurisdiction of one judge. Settlement awards are much larger in MDL cases than in class action lawsuits, and they are based on the injury suffered.
